BY ACCESSING OR USING FOTOSHOOT.AI, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE OUR SERVICE. THESE TERMS INCLUDE A BINDING ARBITRATION CLAUSE AND WAIVER OF CLASS ACTION RIGHTS.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Fotoshoot.ai ("Company," "we," "us," or "our") governing your access to and use of the Fotoshoot.ai website, platform, and all related services (collectively, the "Service").

By creating an account, accessing, or using our Service, you confirm that you:

  • Accept and agree to be bound by these Terms and our Privacy Policy
  • Will comply with all applicable laws and regulations

2. Service Description

Fotoshoot.ai is an AI-powered platform that transforms product images into fashion photography. Our Service allows users to:

  • Upload product images for AI processing
  • Generate AI-enhanced fashion photography
  • Purchase credits for image generation
  • Download and use generated images

AI LIMITATIONS: The Service utilizes artificial intelligence which may produce unexpected, imperfect, or unsuitable results. AI-generated images may contain errors, artifacts, or distortions. We make no guarantees regarding the quality, accuracy, or suitability of any AI-generated content.

3. Account Registration and Security

To use our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept full responsibility for all activities under your account

YOU ARE SOLELY RESPONSIBLE FOR ALL ACTIVITIES THAT OCCUR UNDER YOUR ACCOUNT. WE ARE NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO PROTECT YOUR ACCOUNT CREDENTIALS.

4. Credits, Payments, and Refunds

4.1 Credit System

Our Service operates on a credit-based system. Credits are required to generate images and are consumed upon each generation request.

4.2 Purchases

  • All credit purchases are processed through our payment provider (Ziina)
  • Prices are displayed in your selected currency and are subject to change
  • You agree to pay all applicable fees and taxes
  • Credits are added to your account upon successful payment confirmation

4.3 No Refunds Policy

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. CREDITS CANNOT BE EXCHANGED FOR CASH, TRANSFERRED TO OTHER USERS, OR REFUNDED UNDER ANY CIRCUMSTANCES. BY MAKING A PURCHASE, YOU ACKNOWLEDGE AND ACCEPT THIS NO-REFUND POLICY.

4.4 Credit Expiration

Credits may be subject to expiration as specified at the time of purchase. Expired credits are forfeited and cannot be restored.

5. User Content and Responsibilities

5.1 Your Content

You retain ownership of the original images you upload to our Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Process your images through our AI systems
  • Store your images on our servers
  • Display your images within your account
  • Use anonymized data for service improvement

5.2 Content Requirements

YOU REPRESENT AND WARRANT THAT:

  • You own or have all necessary rights to the content you upload
  • Your content does not infringe any third-party intellectual property rights
  • Your content complies with all applicable laws
  • You have obtained all necessary permissions, releases, and consents

5.3 User Responsibility

YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR ALL CONTENT YOU UPLOAD AND ALL AI-GENERATED IMAGES YOU CREATE, DOWNLOAD, DISTRIBUTE, OR USE. YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF ANY AI-GENERATED CONTENT.

6. Prohibited Uses

You agree NOT to use the Service to:

  • Generate, upload, or distribute illegal content
  • Create explicit, pornographic, or sexually suggestive content
  • Generate content depicting real individuals without their consent
  • Create content that is defamatory, harassing, or threatening
  • Infringe upon any intellectual property or proprietary rights
  • Impersonate any person or entity
  • Spread malware, viruses, or harmful code
  • Circumvent any security measures or access restrictions
  • Use the Service for any fraudulent or deceptive purposes
  • Resell, redistribute, or commercialize access to the Service
  • Reverse engineer or extract our AI models or technology
  • Overload or interfere with the Service's operation
  • Violate any applicable laws, regulations, or third-party rights

We reserve the right to terminate your account immediately and without notice for any violation of these prohibited uses.

7. AI-Generated Content Rights

Subject to your compliance with these Terms:

  • You may use AI-generated images for personal and commercial purposes
  • We do not claim ownership of AI-generated outputs
  • You are responsible for ensuring your use complies with applicable laws

HOWEVER, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING INTELLECTUAL PROPERTY RIGHTS IN AI-GENERATED CONTENT. IT IS YOUR RESPONSIBILITY TO ENSURE YOUR USE OF AI-GENERATED IMAGES DOES NOT INFRINGE ANY THIRD-PARTY RIGHTS.

8. Intellectual Property

The Service, including its design, features, technology, AI models, trademarks, and all related intellectual property, is owned by Fotoshoot.ai and protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or technology without our express written permission.

9. Service Availability and Modifications

We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time without notice
  • Change pricing, features, or credit costs
  • Impose limits on certain features or restrict access
  • Perform maintenance that may result in temporary unavailability

WE ARE NOT LIABLE FOR ANY MODIFICATIONS, SUSPENSIONS, OR DISCONTINUATIONS OF THE SERVICE.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • At our sole discretion for any other reason

Upon termination, your right to use the Service ceases immediately. Any unused credits will be forfeited and are not refundable.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING THE QUALITY OF AI-GENERATED CONTENT
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED

YOU USE THE SERVICE AT YOUR OWN RISK. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOTOSHOOT.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • PERSONAL INJURY OR PROPERTY DAMAGE
  • UNAUTHORIZED ACCESS OR ALTERATION OF YOUR DATA
  • CONDUCT OF ANY THIRD PARTY ON THE SERVICE
  • ANY OTHER MATTER RELATING TO THE SERVICE

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED ZERO DOLLARS ($0.00). THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

13. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS FOTOSHOOT.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBTS, AND EXPENSES (INCLUDING ATTORNEY'S FEES) ARISING FROM:

  • Your use of and access to the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you upload, generate, or distribute using the Service
  • Any claim that your content caused damage to a third party
  • Your misuse of AI-generated content

THIS INDEMNIFICATION OBLIGATION WILL SURVIVE THE TERMINATION OF THESE TERMS AND YOUR USE OF THE SERVICE.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain, without regard to its conflict of law provisions.

14.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the rules of the Bahrain Chamber for Dispute Resolution. The arbitration shall be conducted in English and held in Manama, Bahrain.

14.3 Waiver of Class Action

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fotoshoot.ai regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

YOU FURTHER ACKNOWLEDGE THAT THESE TERMS CONSTITUTE A COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND FOTOSHOOT.AI, AND THAT THEY SUPERSEDE ANY PRIOR AGREEMENTS OR UNDERSTANDINGS.
